COURT REPORTER TRAINING – WINTER RECESS

CSEA Judiciary Local 330 has arranged this training and is offering space to our Local 334 members.  This training is for active CSEA members only, you will be required to supply your CSEA ID# to register.  Space is limited, please send an email to ian@csealocal334.com if interested prior to 12/8/22.

LIGHTS ON THE LAKE

Lights on The Lake is New York’s premier drive-through holiday light show. Every year our brothers and sisters from CSEA Local 834 proudly setup and maintain two miles of breathtaking displays for all to enjoy.  Due to limited availability we ask that you RSVP to dave@csealocal334.com and include your name, member # and mailing address by 12/16/22, one ticket per member please.  Again this year the Local felt it necessary to do something for all of you, as a result tickets will be free to our 334 members throughout the Local.  This year’s tickets will be good for one time use on Monday through Thursday. Get yours while they are here, they will not last long and are being distributed on a first come, first served basis.

As you may be aware, CSEA Judiciary and UCS reached a Tentative Agreement on November 8, 2022.  Attached is a side-by-side comparison of the current 2020-2021 collective bargaining agreement and the new Tentative Agreement.  On November 21, 2022 CSEA will send ballots to vote on this Tentative Agreement via electronic means Election Buddy, to members whose non-work email addresses are on record with CSEA; and a paper ballot and return envelope to members for whom CSEA does not have a non-work email address.

To check/correct/ or add an email address please call: 1-800-342-4146  or send an email informing them of a correct email address at: membersolutionscenter@CSEAINC.ORG no later than Friday, November 18, 2022.

For those members whose email addresses are on record and who will receive the Election Buddy notification, please DO NOT forward the notification that you receive to another party or email address.  Once the email is forwarded, and anyone else uses it, that will count as YOUR vote.  Once you have voted on Election Buddy, the email will disappear, but you will receive a receipt confirming your vote.  All ballots, paper and electronic, are due back to CSEA by close of business on December 21, and all ballots will be counted on December 22, 2022.

CSEA will be sending out reminder emails to vote periodically to emails which have not cast a vote.  Each reminder will contain a valid ballot that you can use to vote, so you do not need to search your emails to find a ballot.  Anyone who has cast a vote through Election Buddy will not receive any further reminders.

CONTRACT NEGOTIATIONS

After over one year of negotiations, we are happy to announce that we have reached a Tentative Agreement with OCA for the period of April 1, 2021 through March 31, 2026.  This contract will include a 13% raise over five years, plus a $3,000 signing bonus for all active employees of UCS as of date of ratification,  as well as other enhanced benefits.  All of the details of this Tentative Agreement are being prepared and will be provided to our members.  Membership Meetings will be scheduled to explain the changes in the Tentative Agreement and questions will be answered.  Please check with your Local President (Ian Spencer, mail to: ian@csealocal334.com) if you do not receive a synopsis of the Tentative Agreement by November 18, 2022.  The negotiating team thanks all our members for your patience and support during this period.  Our unity has resulted in a good Tentative Agreement for you to consider and vote on.

The Judiciary negotiating team met with OCA again on August 3 and had another productive session, having reached agreement on some language changes and discussing others. While recent sessions have been constructive, there is still much work left to do and we have set an additional date for negotiations on August 24.  The team continues to seek a longer-term agreement with increased benefits for its members.  Please remember that it would be unduly detrimental to the bargaining process, to set forth the specifics of any proposals.  Rest assured that the CSEA Team will continue to pursue an agreement that will address concerns and issues raised by the membership.

Many of you have inquired recently regarding access to your respective CSEA ID numbers and/or EBF ID’s along with what benefits are available to you as a member. A new, improved version of the MyCSEA app has been released and it features several enhancements.  You can find the app by visiting the Google play store or the App store on your iphone.  On the app you have direct access to all of your personal information as well as EBF benefits, member specific benefits for active CSEA members amongst various other information. All active members will be able to sign into the website directly through the app without entering a password.  I encourage every member to utilize the application in order to have all of your info in the palm of your hand. This version will also update a number of the tools and links available.

CONTRACTUAL OVERTIME
It has been brought to our attention that some members are engaged in work while not on the clock.  Contractually, CSEA members employed within the Judiciary branch of government are scheduled for a 35 hour workweek.  Anytime spent working outside of those scheduled hours is considered overtime.  If members are not receiving overtime pay (either scheduled or unscheduled) they should not be engaging in any work activity outside of the regular scheduled shift.  Any work accomplished should be done while on the clock.  With this being said you must let your supervisor know when this happens either by email or phone call. If there is a refusal to pay for overtime contact us immediately, you are entitled to that time. If you work off the clock you are not helping anyone. In order to get help you must demonstrate that it is needed.  We understand there is plenty of work and it has certainly increased since the court system has gone virtual and new laws and practices being implemented. All of these changes add to your workload and we must demonstrate the need for increased personnel.

45th AFSCME INTERNATIONAL CONVENTION

Our CSEA AFSCME delegates, who were elected by members in each region, convened to conduct business at the 45th AFSCME International Convention in Philadelphia – this year’s theme was “All Together” and the keynote address was given by AFSCME President Lee Saunders. Other highlights of the five-day convention included a moving tribute to the late Jerry McEntee and an impassioned speech from Georgia gubernatorial candidate and voting rights activist Stacey Abrams. SURVEILLANCE TESTING

CSEA is aware that some health insurance plans have ceased paying the cost of surveillance COVID testing and are now only covering the cost of symptomatic testing.  CSEA is discussing this issue with the Empire Plan and as members notify us of other health insurance plan notifications, we are speaking with them about this issue.  As you may know, CSEA was the only Union that filed an Improper Practice charge at PERB last October specifically claiming that the cost of testing was a mandatory subject of bargaining.  That IP was consolidated with the mandated vaccine IP and was heard in April; CSEA is awaiting a determination on both cases from the Administrative Law Judge assigned.

In the meantime, CSEA has requested that OCA allow its members to perform home COVID tests and then if positive, be tested at a pharmacy.  OCA refused that request and stated they would not accept the results of home tests.  CSEA will continue to push for changes to this policy.

COURT CONSOLIDATION

In January of 2022, Office of Court Administration submitted legislation to the NYS Assembly and Senate to restructure the court system statewide.  Thanks to all the CSEA members who sent messages through the CSEA portal to their legislators in opposition to the OCA plan—you won the day!  The legislation which included no job security provisions for non-judicial employees and would have reshuffled county courts into Supreme Courts and would end Court of Claims and Surrogates as standalone courts was defeated in committee.

LOCAL 334 SCHOLARSHIPS

The Local 334 Scholarship Committee met and awarded academic and financial assistance scholarships to graduating seniors, whose parents are employed by the Unified Court System and CSEA members in good standing.  Please see the attached notice from the Local with a description of each student.  The Lt. Michael Carraway Memorial Scholarship is named in memory of retired Judiciary Local 334 President, Sharon Carraways husband and Father of Local 334 Member/Scholarship Committee member Natalie Carraway.  Lt. Carraway was a Utica Police Lieutenant and Union activist who passed unexpectedly in 1994.

CSEA LOCAL 834 CLAMBAKE

JUNE 28TH PRIMARY

Primary elections for statewide office (Governor, Lieutenant Governor, Attorney General, Comptroller, where applicable) and state assembly will be held on June 28.  New York makes it very convenient to vote and CSEA has all the information available in one easy spot, cseany.org/vote.  If you intend to vote by absentee ballot, the last day to request one by mail was June 13 OR in-person at your county board of elections by June 27.  Completed and signed ballots must be postmarked by June 28th.

CSEA LOCAL 834 CLAMBAKE  

Onondaga County Local 834 President Dan Vadala has once again extended an invitation to Local 334 and our membership, to join his local in their yearly clambake on Sunday June 26th, 2022 from 1-6 at Sharkey’s bar and grill in Liverpool, NY.  Join your Local Officers for tons of food, raffles, door prizes and more, no tickets sold at the door.  Local 334 members make your reservations with us by mailing the attached reservation form with payment to Ian Spencer, 5805 Noel Rd., Cicero, Ny 13039.  Reservation deadline is Friday June 10th,  see the attached flyer and reservation form for complete details.  A brief membership meeting will be held with those local 334 members in attendance.

COURT CONSOLIDATION

The email campaign regarding the court consolidation proposal is set up at https://actionnetwork.org/letters/say-no-to-court-consolidation/. It’s also posted on our website at https://cseany.org/issues  As you are aware, the UCS has gotten both chairs of the Senate and Assembly judicial committees to sponsor their bill to consolidate the courts.  CSEA and your Local 334 executive team encourage you to send an email to oppose the Chief Judge’s proposal.

Under this proposal, the state’s 11 trial courts would be consolidated into three: the Supreme Court (consisting of Family, Probate, Criminal, State Claims, Commercial, and General divisions), a Municipal Court (consisting of the NYC civil / criminal courts, Long Island District Courts, and the 61 Upstate City Courts), and the Justice Courts (town / village courts that wouldn’t see a change).

It is said that this proposal will result in savings to the court system. In reality, what this means is that as courts are consolidated, fewer staff will be tasked with more responsibility, further stressing a workforce that has already shrunk by at least 12% since 2009.

IRVING FLAUMENBAUM SCHOLARSHIP – Deadline extended

The last date to apply for CSEA’s statewide college scholarship awards will be May 15. If you know of CSEA members who have graduating high school seniors, this is your last chance to share the application information with them. CSEA will give out eighteen $1,000 Irving Flaumenbaum Memorial Scholarships, three in each of our six regions. We also have two additional college scholarship opportunities available through the same application. The application is available for download at: https://cseany.org/scholarships.

It’s also posted on our website at https://cseany.org/issues  As you are aware, the UCS has gotten both chairs of the Senate and Assembly judicial committees to sponsor their bill to consolidate the courts.  CSEA and your Local 334 executive team encourage you to send an email to oppose the Chief Judge’s proposal.

Under this proposal, the state’s 11 trial courts would be consolidated into three: the Supreme Court (consisting of Family, Probate, Criminal, State Claims, Commercial, and General divisions), a Municipal Court (consisting of the NYC civil / criminal courts, Long Island District Courts, and the 61 Upstate City Courts), and the Justice Courts (town / village courts that wouldn’t see a change).

It is said that this proposal will result in savings to the court system. In reality, what this means is that as courts are consolidated, fewer staff will be tasked with more responsibility, further stressing a workforce that has already shrunk by at least 12% since 2009.

INCREMENTS / LONGEVITY and SLED PAYMENTS

CSEA has been notified that increment payments as well as SLED and Longevity payments will be reflected in the April 27th, 2022 pay advice.

IRVING FLAUMENBAUM SCHOLARSHIP – Deadline extended

Every year, our union offers eighteen $1,000 Irving Flaumenbaum Memorial Scholarships to the dependent children of CSEA members who are graduating high school seniors, three in each of our six regions. We also have two additional college scholarship opportunities available through the same application form. You can download this year’s application form at: https://cseany.org/scholarships, where you can also download a poster to print and post around your workplaces. The deadline for submitting scholarship applications is May 15, 2022.

REGION 5 SCHOLARSHIP

MICHAEL D. CARRAWAY SCHOLARSHIP – Deadline extended

It is with great pleasure CSEA Judiciary Local 334 announces the 2022 Lt. Michael D. Carraway Memorial Scholarship Program.  Graduating seniors who are a child or legal dependent of a court employee represented by CSEA Judiciary Local 334  and will be attending an accredited institution of higher education are eligible to apply.  Applications due by April 29, 2022
